- Introduction
These Terms and Conditions govern the use of Everytime Care’s temporary staffing and recruitment services. By engaging with our services, clients and candidates agree to be bound by these terms. - Definitions
“Company” refers to Everytime Care, registered in the UK under company number 14391789.
“Client” refers to any organisation or business engaging Everytime Care for temporary staffing solutions.
“Temporary Worker” refers to an individual engaged by Everytime Care and assigned to a client for temporary work.
“Assignment” refers to the period during which a temporary worker is supplied to a client.
“Services” refer to the provision of temporary workers and recruitment solutions by Everytime Care.
- Supply of Temporary Workers
Everytime Care supplies temporary workers to clients under agreed terms, ensuring compliance with employment and agency regulations.
The client is responsible for supervising, directing, and ensuring the health and safety of the temporary worker during the assignment.
Everytime Care does not guarantee the availability of specific temporary workers or continuity of assignments.
- Fees and Charges
Clients agree to pay fees based on the agreed hourly/daily rate for each temporary worker.
Charges are invoiced weekly unless otherwise agreed, and payment is due within the timeframe specified in the invoice.
Additional costs such as overtime, holiday pay, or statutory contributions will be outlined in the client agreement.
- Timesheets and Payment
Temporary workers must submit approved timesheets detailing hours worked.
Clients must verify and approve timesheets promptly.
Everytime Care pays temporary workers directly and invoices clients accordingly. Late payments by clients may result in interest charges.
- Temporary Worker Engagement
Temporary workers remain under contract with Everytime Care and are not employees of the client.
Clients must not engage a temporary worker directly without prior agreement with Everytime Care.
If a client hires a temporary worker directly or through another agency within 12 months of the last assignment, a transfer fee may apply.
- Cancellations and Termination
Clients must provide reasonable notice for cancellation of an assignment.
Everytime Care reserves the right to withdraw temporary workers from assignments due to non-payment or breach of contract.
Temporary workers may be removed from an assignment if they fail to meet performance or compliance requirements.
- Compliance and Responsibilities
Everytime Care ensures that temporary workers have the necessary rights to work in the UK.
Clients must comply with all applicable employment laws, health and safety regulations, and provide a safe working environment.
Clients must not unlawfully discriminate against temporary workers.
- Data Protection and Confidentiality
Everytime Care processes personal data in accordance with UK GDPR regulations.
Clients and temporary workers agree to keep all information received through Everytime Care confidential.
- Liability
Everytime Care is not liable for any loss, damage, or costs incurred by the client due to temporary worker performance, absence, or termination.
Our liability is limited to the fees paid for the services provided.
- Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts.
